1.When the right applies
The right of withdrawal under the Swedish Distance Contracts Act (2005:59) applies when a consumer enters into a service contract with a trader at a distance.
Whether it applies to a given POFFIX agreement depends on who your contracting party is: a trader (a business or POFFIX) or a private individual. The Act does not apply between two private individuals.
Decision required: Who contracts with the customer – this determines whether and against whom the right applies.
2.Withdrawal period
The period is 14 days from the day the contract was concluded, i.e. when both parties approved the same price offer.
If you were not informed about the right of withdrawal, the period is extended as set out in the Act.
3.If work starts within the period
Work starts within the withdrawal period only if you expressly request it. If you withdraw after work has started you may have to pay for the part already performed, in proportion to the whole service.
If the service has been fully performed at your express request and you acknowledged that the right then ends, no right of withdrawal remains.
Decision required: Flow for an express request for early start and acknowledgement that the right ends on full performance.
4.How to withdraw
Use the Withdraw from contract function below. Enter your name, the task reference and the email for the receipt, and press Confirm withdrawal. We record the time of receipt and send a receipt.
You may also notify your contracting party in another clear way. The right does not depend on a particular form.
5.Refund
If you have paid, the amount, less any proportionate payment for work performed, must be refunded no later than 14 days after the withdrawal notice was received. Payments run in test mode today.
6.Difference from cancellation
You can always cancel under our cancellation policy in My tasks. The right of withdrawal is a statutory right that applies independently.
